HB 2666: sexual extortion; classification

Overview
Modifies the classification for sexual extortion to be a class 2 felony if the offender is 18 years of age or older and the victim is 15, 16 or 17 years of age.
History
A person commits sexual extortion by knowingly communicating a threat with the intent to coerce another person to engage in sexual acts or to provide photos or videos that are of a sexual nature (A.R.S. § 13-1428).
Under current statute, if the victim is above the age of 15, sexual extortion is a class 3 felony, and the convicted person is ineligible for early release or probation except specifically outlined in statute for work detail or medical treatment. If the victim is below the age of 15, sexual extortion is a class 2 felony and is punishable as a dangerous crime against a child (A.R.S. §§ 13-705; 13-1428).
Provisions
1. Changes the classification of sexual extortion to a class 2 felony if:
a. the offender is 18 years of age or older;
b. the victim is 15, 16 or 17 years of age; and
c. the offender knew or should have known the age of the victim. (Sec. 1)
2. Requires that any sentence imposed due to the aforementioned offense must be served consecutively with any other sentences imposed for sexual extortion. (Sec. 1)
3. Mandates that any person convicted of the aforementioned offense is ineligible for suspension of sentence, probation or release from confinement, except under specific conditions outlined in statute. (Sec. 1)
