ARIZONA STATE SENATE

appropriation; Jackrabbit Trail improvement
(NOW: appropriation; Interstate 10; Jackrabbit Trail)
Purpose
Appropriates a total of $70,000,000 from the state General Fund (state GF) in FYs 2023, 2024 and 2025 to the Arizona Department of Transportation (ADOT) to design and construct a freeway interchange on Interstate 10 (I-10) at Jackrabbit Trail.
Background
ADOT is responsible for the design and construction of state public transportation systems and the maintenance and operation of state highways in Arizona (A.R.S. § 28-332). ADOT may contract and do all things necessary to secure the full benefits available to Arizona for transportation purposes under federal law. ADOT may cooperate with: 1) federal, state and local government agencies; 2) Indian tribes; 3) private and public organizations; and 4) private individuals. ADOT may exchange federal monies with local governments in order to receive local monies and may include additional federal monies in the exchange to offset the matching costs required of local governments (A.R.S. § 28-334).
Jackrabbit Trail is a county road that runs between Indian School Road and Tuthill Road in the City of Buckeye (Maricopa County). I-10 exits to Jackrabbit Trail at Exit 121 (ADOT).
Construction-manager-at-risk project delivery is a project
delivery method in which:
1) there is a construction services contract that is separate from the design
services contract, except that, instead of a single construction services
contract, ADOT may elect separate contracts for preconstruction, construction
and any other construction services; 2) design services are performed under a
separate design services contract, except as specified; 3) the construction
services contract may be entered into at the same time as the design services
are commenced or at a later time;
4) project design and construction may be sequential, with the entire design
complete before construction commences, or concurrent, with the design produced
in two or more phases and construction of some phases commencing before the
entire design is complete; and 5) finance, maintenance, operations,
preconstruction and other related services may be included (A.R.S.
§ 28-7361).
H.B. 2285 appropriates $5,000,000 from the state GF in FY 2023 to ADOT to design a freeway interchange on I-10 at Jackrabbit Trail and appropriates $30,000,0000 in FY 2024 and $35,000,000 in FY 2025 from the state GF to ADOT to construct a freeway interchange on I-10 at Jackrabbit Trail.
Provisions
1. Appropriates $5,000,000 from the state GF in FY 2023 to ADOT to design a freeway interchange on I-10 at Jackrabbit Trail.
2. Appropriates $30,000,000 in FY 2024 and $35,000,000 in FY 2025 from the state GF to ADOT to construct a freeway interchange on I-10 at Jackrabbit Trail, including all:
a) traffic control devices for on-ramps and off-ramps related to the freeway interchange; and
b) related and necessary traffic control devices to the north and south of the freeway interchange at Jackrabbit Trail and McDowell Road.
3. Declares the Legislature's intent that ADOT use any federal monies available for the projects to supplement the appropriated monies.
4. Requires ADOT, upon receiving federal monies, to revert an amount equal to any federal monies received, but not more than the total amount appropriated, to the state GF.
5. Declares the Legislature's intent that the design and construction of the freeway interchange at Jackrabbit Trail be accelerated.
6. Requires ADOT to use the construction-manager-at-risk project delivery method to complete the project.
7. Exempts the appropriations from lapsing.
8. Becomes effective on the general effective date.
