Gila River Indian Community plates.

Purpose

Establishes a Gila River Indian Community special plate, an Ak-Chin Indian Community special plate, a Pascua Yaqui Tribe special plate, a humanitarian service organization special plate and an Arizona professional soccer club special plate. Allows a request for a national guard member special plate to be combined with a request for a personalized special plate, as prescribed.

Background

The Arizona Department of Transportation (ADOT) Motor Vehicle Division provides one license plate to every motor vehicle owner for each vehicle registered (A.R.S. § 28-2351). ADOT is required to issue or renew special plates in lieu of regular license plates under specified conditions and procedures (A.R.S. § 28-2403). The fee for obtaining or renewing a special plate is $25 (A.R.S. § 28-2402). Of the $25 fee, $8 is an administration fee that ADOT deposits in the State Highway Fund (SHF) and $17 is a donation.

ADOT must issue national guard member special plate to a person who submits satisfactory proof to ADOT that the person is or has been a member of the Arizona Army National Guard or the spouse of a person who is or has been a member of the Arizona Army National Guard. The Director of ADOT (Director) must deposit all special plate administration fees in the SHF and transmit national guard member special plate donations to the Morale, Welfare and Recreational Fund. ADOT may not issue national guard member special plates to a person, or to the spouse of a person, who was discharged from the U.S. Armed Forces under less than honorable conditions (A.R.S. § 28-2415).

               There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

Gila River Indian Community Special Plate

1.   Requires ADOT to issue a Gila River Indian Community special plate if, by December 31, 2023, a person pays the $32,000 implementation fee.

2.   Requires the person that provides the implementation fee to design the Gila River Indian Community special plate, subject to ADOT approval.

3.   Allows the Director to combine a request for a Gila River Indian Community special plate with a request for a personalized special plate.

4.   Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the Gila River Indian Community special plate and personalized special plate.

5.   Specifies that, of the $25 fee required to obtain or renew a Gila River Indian Community special plate, $8 is an administration fee and $17 is an annual donation.

6.   Requires ADOT to deposit all special plate administration fees in the SHF and transmit Gila River Indian Community special plate donations to the Gila River Indian Community Transportation Committee.

7.   Requires the Gila River Indian Community Transportation Committee to use the monies only for traffic control devices, as prescribed by the Manual on Uniform Traffic Control Devices, on highways on the Gila River Indian Reservation in Arizona that are not state highways.

Ak-Chin Indian Community Special Plate

8.   Requires ADOT to issue an Ak-Chin Indian Community special plate if, by December 31, 2023, a person pays the $32,000 implementation fee.

9.   Requires the person that provides the implementation fee to design the Ak-Chin Indian Community special plate, subject to ADOT approval.

10.  Allows the Director to combine a request for an Ak-Chin Indian Community special plate with a request for a personalized special plate.

11.  Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the Ak-Chin Indian Community special plate and personalized special plate.

12.  Specifies that, of the $25 fee required to obtain or renew an Ak-Chin Indian Community special plate, $8 is an administration fee and $17 is an annual donation.

13.  Requires ADOT to deposit special plate administration fees in the SHF and transmit Ak-Chin Indian Community special plate donations to the Ak-Chin Indian Community Department of Public Safety.

14.  Requires the Ak-Chin Indian Community Department of Public Safety to use the monies only for traffic control devices, as prescribed by the Manual on Uniform Traffic Control Devices, on highways on the Ak-Chin Indian Reservation in Arizona that are not state highways.

Pascua Yaqui Tribe Special Plate

15.  Requires ADOT to issue a Pascua Yaqui Tribe special plate if, by December 31, 2023, a person pays the $32,000 implementation fee.

16.  Allows the Director to combine a request for a Pascua Yaqui Tribe special plate with a request for a personalized special plate.

17.  Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the Pascua Yaqui Tribe special plate and personalized special plate.

18.  Specifies that, of the $25 fee required to obtain or renew a Pascua Yaqui Tribe special plate, $8 is an administration fee and $17 is an annual donation.

19.  Requires ADOT to deposit all special plate administration fees in the SHF and transmit all Pascua Yaqui Tribe special plate donations to the Pascua Yaqui Tribe.

20.  Requires the Pascua Yaqui Tribe to use donated monies only for:

a)   education scholarships, including academic-related and extracurricular activities, for children in the Pascua Yaqui Tribe; and

b)   legal assistance for unrepresented persons.

Humanitarian Service Organization Special Plate

21.  Requires ADOT to issue a humanitarian service organization special plate if, by December 31, 2023, a person pays the $32,000 implementation fee to ADOT.

22.  Requires the person that provides the implementation fee to design the humanitarian service organization special plate.

23.  Subjects the design and color of the humanitarian service organization special plate to ADOT approval.

24.  Allows the Director to combine a request for a humanitarian service organization special plate with a request for a personalized special plate.

25.  Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the humanitarian service organization special plate and personalized special plate.

26.  Specifies that, of the $25 fee required to obtain or renew a humanitarian service organization special plate, $8 is an administration fee and $17 is an annual donation.

27.  Requires the first $32,000 in the Humanitarian Service Organization Special Plate Fund (Humanitarian Fund) to be reimbursed to the person that paid the implementation fee.

28.  Requires ADOT to deposit special plate administration fees in the SHF and humanitarian service organization special plate donations in the Humanitarian Fund.

29.  Establishes the Humanitarian Fund consisting of humanitarian service organization special plate donations.

30.  Specifies that no more than 10 percent of monies deposited in the Humanitarian Fund annually may be used for administering the Humanitarian Fund.

31.  Requires, on notice from the Director, the State Treasurer to invest and divest Humanitarian Fund monies and to credit monies earned to the Humanitarian Fund.

32.  Specifies that Humanitarian Fund monies are continuously appropriated.

33.  Requires the Director to annually allocate Humanitarian Fund monies, excluding administrative fees, to a 501(c)(3) organization that:

a)   has a global network of at least 1,200,000 persons who make a positive and lasting change in communities in and outside of the United States;

b)   takes action on sustainable projects;

c)   works to better the world and communities through projects relating to literacy, peace, water and health;

d)   has been in Arizona since 1914;

e)   has at least 114 clubs in Arizona and has more than 5,000 members in Arizona; and

f) has raised monies in Arizona to support service projects promoting peace, fighting disease, providing clean water, sanitation and hygiene, saving mothers and children, supporting education, growing local economies and protecting the environment.

Arizona Professional Soccer Club Special Plate

34.  Requires ADOT to issue an Arizona professional soccer club special plate if, by December 31, 2023, a person pays the $32,000 implementation fee.

35.  Requires the person that pays the implementation fee to design the Arizona professional soccer club special plate.

36.  Specifies that the design and color of the Arizona professional soccer club special plate are subject to the approval of ADOT.

37.  Allows the Director to combine a request for an Arizona professional soccer club special plate with a request for a personalized special plate.

38.  Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the Arizona professional soccer club special plate and personalized special plate.

39.  Specifies that, of the $25 fee required to obtain or renew an Arizona professional soccer club special plate, $8 is an administration fee and $17 is an annual donation.

40.  Establishes the Arizona Professional Soccer Club Special Plate Fund (Soccer Fund) consisting of Arizona professional soccer club special plate donations.

41.  Requires ADOT to deposit all special plate administration fees in the SHF and Arizona professional soccer club special plate donations in the Soccer Fund.

42.  Requires the first $32,000 in the Soccer Fund to be reimbursed to the person who paid the implementation fee.

43.  Prohibits more than 10 percent of monies annually deposited in the Soccer Fund from being used for administration costs.

44.  Requires the Director to annually allocate Soccer Fund monies, excluding administrative fees, to a 501(c)(3) organization that:

a)   is an Arizona professional soccer club foundation;

b)   has a mission to support the development of student athletes in the community by focusing attention on the whole athlete with emphasis on character, teamwork, commitment and self-confidence;

c)   provides financial awards to families with financial barriers to participation in soccer programs; and

d)   develops youth soccer programs in Arizona.

45.  Requires, on notice of the Director, the State Treasurer to invest and divest Soccer Fund monies and to credit monies earned to the Soccer Fund.

46.  Specifies that Soccer Fund monies are continuously appropriated.

Miscellaneous

47.  Allows the Director to combine a request for a national guard member special plate with a request for a personalized special plate.

48.  Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the national guard member special plate and personalized special plate.

49.  Makes technical and conforming changes.

50.  Becomes effective on the general effective date.

Amendments Adopted by Additional Committee of the Whole

1.   Establishes a Pascua Yaqui Tribe special plate, an Arizona professional soccer club special plate and the Soccer Fund.
