restored salvage vehicle titles; inspections

Purpose

Allows the Arizona Department of Transportation (ADOT) to authorize an entity that completes an application and meets requirements to ADOT's satisfaction to perform a level three inspection on a salvage vehicle.

Background

A person who rebuilds or restores a salvage vehicle to operation must apply for a restored salvage certificate of title and submit proper ownership documentation to ADOT before transferring the motor vehicle. ADOT must conduct a level two or three inspection of the vehicle and review submitted documentation to determine the vehicle's proper identity. If ADOT is unable to conduct a level three inspection within 20 days of the request, ADOT must conduct an inspection of the vehicle within 48 hours (A.R.S. § 28-2095).

A level two inspection determines the identity of the vehicle by matching the public vehicle identification number (VIN), a secondary VIN and the confidential VIN to vehicle ownership documents. A level three inspection consists of a level two inspection and the verification of VINs on, at the inspector's discretion, some or all component parts to determine vehicle identity and that the vehicle is properly equipped for highway use (A.R.S. § 28-2011).

               There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Allows ADOT to authorize an entity to conduct a level three inspection, if the entity:

a)   completes an application; and

b)   meets statutory requirements relating to the salvage, seizure and dismantling of vehicles, to ADOT's satisfaction.

2.   Requires, before ADOT may authorize an inspection, an applicant for a restored salvage certificate of title to demonstrate to ADOT's satisfaction that a level three inspection conducted by ADOT is not practical.

3.   Makes technical changes.

4.   Becomes effective on the general effective date.

 

Amendments Adopted by Committee

· Replaces the prescribed persons that ADOT may authorize to conduct a level three inspection on a salvage vehicle with an entity that completes an application and requirements to ADOT's satisfaction.
