ARIZONA STATE SENATE

AMENDED
driver licenses; foster youth
Purpose
Allows an eligible minor, who is at least 16 years old and in foster care in Arizona, to apply for a nonoperating identification license without the signature of a parent, guardian, foster parent or employer of the applicant. Allows a minor at least 16 years old to receive a certified copy of the child's birth registration without the signature of a parent, guardian or foster parent of the child.
Background
Current statute allows the Arizona Department of Transportation to issue a nonoperating identification license on receipt of an application from a person who does not have a valid driver license or whose driving privilege is suspended. The nonoperating identification license contains an assigned number, the full legal name, the date of birth, the residence address and a brief description of the license. Nonoperating identification licenses are solely for the use and convenience of the applicant for identification purposes (A.R.S. § 28-3165).
Current statute also states that an application for an instruction permit, a class G or M driver license or an endorsement for such a license must be signed and verified by an applicable parent, guardian, foster parent or employer (A.R.S. § 28-3160).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Allows an eligible minor, who is at least 16 years old and in foster care in Arizona, to apply for a nonoperating identification license without the signature of a parent, guardian, foster parent or employer of the applicant.
2. Allows an eligible minor, who is at least 16 years old and in foster care in Arizona, to receive a certified copy of the child's birth registration without the signature of a parent, guardian or foster parent of the child.
3. Makes conforming changes.
4. Becomes effective on the general effective date.
Amendments Adopted by Committee
1. Removes language relating to minors in foster care applying for driver licenses without the signature of a parent, guardian, foster parent or employer of the applicant.
2. Allows foster children at least 16 years old to receive a certified copy of the child's birth registration without the signature of a parent, guardian or foster parent of the child.
