FACT SHEET FOR H.B. 2262

 

legacy plates; plate reissuance; reflectivity

Purpose

            Establishes Arizona legacy special plates and the License Plate Reissuance Fund (Fund). Outlines license plate reissuance requirements.

Background

            The Arizona Department of Transportation (ADOT) Motor Vehicle Division provides one license plate to every motor vehicle owner for each vehicle registered (A.R.S. § 28-2351). ADOT is required to issue or renew special license plates in lieu of regular license plates under specified conditions and procedures (A.R.S. § 28-2403). The fee for obtaining or renewing a special license plate is $25 (A.R.S. § 28-2402). Of the $25 fee, $8 is an administration fee that ADOT deposits in the State Highway Fund (SHF) and $17 is a donation to a specific organization.

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires ADOT to reissue a license plate within three years after the warranty on the plate's reflective material expires.

2.   Prohibits ADOT from charging a fee for reissuing a license plate.

3.   Requires the Director of ADOT (Director) to develop standards for reflectivity that use the most current technology available while maintaining a competitive bid process.

4.   Excludes specific license plates from the reissuance requirement.

5.   Requires ADOT, beginning January 1, 2023, to issue Arizona legacy special plates.

6.   Allows the Director to allow a request for Arizona legacy special plates to be combined with a request for personalized special plates.

7.   Specifies that a combined request is required to be submitted on a form prescribed by the Director and is subject to fees for both the Arizona legacy special plate and personalized special plate.

8.   Requires the Arizona legacy special plates to consist of one or more of the outlined designs.

9.   Specifies that, of the $25 fee required to obtain and renew an Arizona legacy special plate, $8 is an administration fee and $17 is an annual donation.

10.  Requires ADOT to deposit all Arizona legacy special plate administration fees in the SHF and all remaining monies into the Fund.

11.  Establishes the Fund which is to be administered by the Director.

12.  Prohibits more than 10 percent of monies in the Fund from being used for administration costs.

13.  Specifies that monies in the Fund are continuously appropriated.

14.  Requires monies in the Fund to pay for the entire cost of reissuing license plates.

15.  Reverts all monies remaining in the Fund at the end of the fiscal year to the state General Fund beginning in FY 2023.

16.  Requires the State Treasurer to invest and divest monies in the Fund and monies earned from investment to be credited to the Fund.

17.  Becomes effective on the general effective date.
