HB 2159: school bus drivers; license requirements

Overview

Allows an applicant for a school bus certification to possess a commercial driver license (CDL) issued by another state if the applicant will be driving for a school district that is adjacent to that state.

History

A person is prohibited from operating a school bus unless the person possesses:

1)   The appropriated CDL class for the size of school bus being operated, issued by the Arizona Department of Transportation (ADOT);

2)   A bus endorsement, issued by ADOT; and

3)   A school bus certification issued by the Arizona Department of Public Safety (DPS). 

To be certified by as a school bus driver a person is required to meet and maintain the minimum standard prescribed by statute and administrative rule adopted by DPS in consultation with the school bus advisory council (A.R.S. § 28-3228).

Pursuant to 13 A.A.C. 13, Article 1, R13-13-102, an applicant for a school bus certification must possess a current Arizona CDL.

The state is allowed to issue CDLs to persons for whom the state is the state of domicile, except under certain outlined conditions (49 CFR § 384.212). The State must allow any person to operate a commercial motor vehicle in the state who is not disqualified from operating a commercial motor vehicle and who hold a CDL that is: 1) issued to him or her by his/her state or jurisdiction of domicile; 2) not disqualified; and 3) valid for the type of vehicle being driven (49 CFR § 384.214).
