Establishes the share the road special
plate and fund. Adjusts the new motor vehicle dealer license plate limit.
History
The Arizona Department of Transportation (ADOT) is required to issue or renew special license plates in lieu of regular license plates under specified conditions and procedures (A.R.S. § 28-2403). A $25 fee is required for each original and each annual renewal of special plates, with some exceptions (A.R.S. § 28-2402). Special license plates currently being offered include Arizona State University, Purple Heart, Child Abuse Prevention, Historic Plate. ADOT currently offers over 60 special license plates.
Currently, ADOT can issue a certain amount of dealer license plates depending on the type of the motor vehicle dealer. New motor vehicle dealers are allowed a maximum of thirty dealer license plates plus one additional license plate for every fifty motor vehicles that are sold based on the reported sales in the previous license year (A.R.S § 28-4533).
Provisions
2. Requires the person who paid the $32,000 to design the plate, subject to ADOT approval. (Sec. 3)
4. Establishes the share the road special plate fund, administered by the Director of ADOT. (Sec. 3)
5. Requires that, of the $25 fee required to obtain and renew a special plate, $8 is an administrative fee and $17 is an annual donation. (Sec. 3)
6. Requires that the $8 administration fee be deposited into the state highway fund and the $17 annual donation be deposited into the share the road special plate fund. (Sec. 3)
7. Requires the first $32,000 in the share the road special plate fund to be reimbursed to the person who paid the implementation fee. (Sec. 3)
8. Requires no more than 10% of monies deposited annually in the share the road special plate fund to be used for administering of the fund. (Sec. 3)
9. States that monies in the share the road special plate fund are continuously appropriated. (Sec. 3)
10. Requires the Director of ADOT to annually allocate monies in the share the road special plate fund, excluding administrative fees, as follows:
a. 50% to a charitable organization that is headquartered in Arizona and promotes safety and awareness in the cycling community; and
b. 50 % to a charitable organization that is headquartered in Arizona and offers the opportunity for a person to use a loaner bicycle if registered in a charity cycling event and cannot afford to purchase vehicle. (Sec. 3)
11. Directs the State Treasurer, upon the notice of the Director of ADOT, to invest and divest monies in the share the road special plate fund.
a. Requires monies earned from investments to be credited to the fund. (Sec. 3)
12. Adjusts the new motor vehicle dealer license plate limit to 150. (Sec. 4)
13. Contains a delayed effective date of October 1, 2019. (Sec. 9)
14. Makes technical and conforming changes. (Sec 1-2, 5-8, 10)
