A MEMORIAL
Urging the president and the Congress of the United States to prohibit the use of funds to implement the affiliates rule.

To the President and the Congress of the United States of America:
Your memorialist respectfully represents:
Whereas, the purpose of the Bureau of Industry and Security (BIS) in the United States Department of Commerce is to advance national security through technology leadership and vigilant export controls; and
Whereas, this country was founded on the principles of limited government intervention in the free market; and
Whereas, burdensome regulations, crippling taxes and rising inflation caused by BIS policies have forced American businesses and industries to make hard decisions; and
Whereas, decisions by the BIS to subsidize certain industries over others have completely ignored the basic principles of the free market that have allowed the United States to thrive and have left control over industrial policy in the hands of unelected bureaucrats; and
Whereas, on September 30, 2025, the BIS issued the Affiliates Rule as an interim final rule that extended export control restrictions to any entity owned 50% or more by one or more parties listed on either the BIS Entity List or the Military End-User List; and
Whereas, this Affiliates Rule adds another layer of bureaucracy and control by big government in the market, making it harder for American industries to conduct business freely; and
Whereas, on November 1, 2025, President Donald Trump announced that he will suspend the Affiliates Rule for a year as a concession reached during recent trade negotiations between the United States and the People's Republic of China; and
Whereas, it is crucial that American exporters and industries be protected from government overreach and burdensome regulations.
Wherefore your memorialist, the House of Representatives of the State of Arizona, prays:
1. That the President and Congress of the United States:
(a) Indefinitely suspend the implementation of the Bureau of Industry and Security's Affiliates Rule.
(b) Defund the BIS and repeal burdensome regulations on the free market to protect American businesses, exporters and industries.
2. That the Secretary of State of the State of Arizona transmit copies of this Memorial to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives and each Member of Congress from the State of Arizona.
