impeachable offenses
Purpose
Subject to voter approval, constitutionally requires the Governor and other state and judicial officers to be liable to impeachment for failing to follow and enforce a state law or court rule.
Background
The Arizona Constitution prohibits a person from being convicted for impeachment without a concurrence of two-thirds of the senators elected. The Governor and other state and judicial officers, except justices of courts not of record, must be liable to impeachment for high crimes, misdemeanors or malfeasance in office, but judgment in such cases must extend only to the removal from office and disqualification to hold any office of honor, trust or profit in Arizona. The party must be liable to trial and punishment according to the law, whether convicted or acquitted (Ariz. Const. art. 8 § 2).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Adds failing to follow and enforce a state law or court rule to the possible grounds for impeachment of the Governor and other state and judicial officers.
2. Makes technical and conforming changes.
3. Requires the Secretary of State to submit the proposition to the voters at the next general election.
4. Becomes effective if approved by the voters and on proclamation of the Governor.
