ARIZONA STATE SENATE
Fifty-Seventh Legislature, Second Regular Session
county sheriffs; expressing support
Purpose
Expresses the Legislature's support for and recognition of county sheriffs in Arizona and encourages all Arizonans to support and appreciate their county sheriffs.
Background
A county sheriff
is elected by qualified voters within a respective county in Arizona and holds
office for a four-year term (Ariz.
Const. art. 12 § 3). A county sheriff's duties include:
1) preserving the peace; 2) arresting and taking before the nearest magistrate
for examination all persons who attempt to commit or who have committed a
public offense; 3) preventing and suppressing all affrays, breaches of the
peace, riots and insurrections that may come to the knowledge of the sheriff;
4) attending all courts, except justice and municipal courts, when an element
of danger is anticipated and attendance is requested by the presiding judge;
and
5) operating and maintaining the county jail (A.R.S.
§ 11-441).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Declares that the members of the Legislature:
a) reaffirm their support of all county sheriffs in Arizona;
b) recognize the supreme constitutional authority, derived from the people, of county sheriffs over their respective jurisdictions; and
c) encourage all Arizonans to support their county sheriffs and appreciate their service to our communities.
