FACT SHEET FOR H.B. 4043

 

training; AEDs; CPR; school personnel

Purpose

Requires, beginning August 1, 2027, each school district and charter school to ensure that there is at least one employee at each school campus during regular school hours who has successfully completed a training course in cardiopulmonary resuscitation (CPR) and first aid, and if there is at least one automated external defibrillator (AED) at the school campus, the use of AEDs.

Background

On request by a student's parent or guardian, each school district or charter school must provide information describing the types of emergency response training, including CPR training, that a school district or charter school requires school employees to complete (A.R.S. § 15-160.04).

Beginning August 1, 2026, each public school that provides instruction to students in any of grades 9 through 12 and sponsors an athletic team or sports program must provide an AED at each school campus and school-sponsored athletic event and ensure that each provided AED is: 1) in an unlocked location that is clearly marked and easily accessible both during the school day and at each school-sponsored athletic event; 2) in a location from which the AED may be promptly retrieved and used at the school or school-sponsored athletic event; 3) in a location that complies with guidelines that are established by a nationally recognized organization that is focused on emergency cardiovascular care; and 4) maintained in good working order and tested according to the manufacturer's guidelines (A.R.S. § 15-120.07).

AED means a medical device heart monitor and defibrillator that: 1) is approved for premarket modification by the U.S. Food and Drug Administration; 2) is capable of recognizing the presence or absence of ventricular fibrillation or rapid ventricular tachycardia and is capable of determining, without intervention by an operator, if defibrillation should be performed; and 3) automatically charges and delivers an electrical impulse to a person's heart when it determines that defibrillation should be performed (A.R.S.  § 36-2261).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires, beginning August 1, 2027, each school district and charter school to ensure that there is at least one employee at each school campus during regular school hours who has successfully completed:

a)   a training course in CPR and first aid that follows nationally recognized cardiovascular care guidelines; and

b)   if there is at least one AED at the school campus, a training course in the use of AEDs that follows nationally recognized cardiovascular care guidelines. 

2.   Makes conforming changes.

3.   Becomes effective on the general effective date.
