Purpose
Allows a county sheriff to use the aid of volunteer posse and reserve organizations, and grants a county sheriff the exclusive right, when activated, to regulate the organization and equipment of a posse or reserve organization under the sheriff's authority and written policy.
Background
A county sheriff, in executing the duties of the office, may request the aid of volunteer posse and reserve organizations located in the sheriff's county. A county sheriff may authorize members of the sheriff's volunteer posse to carry a deadly weapon without a permit while on duty if the member has received and passed firearms training that is approved by the Arizona Peace Officer Standards and Training Board (A.R.S. § 11-441).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Grants the county sheriff, when activated by the sheriff, the exclusive authority to regulate the organization and equipment that is used by a posse or reserve organization or members of a posse or reserve organization that are acting within the sheriff's authority and written policy in support of the sheriff's office, consistent with law.
2. Specifies that a county sheriff may use the requested aid of volunteer posse and reserve organizations located in the county in executing the sheriff's duties.
3. Makes technical changes.
4. Becomes effective on the general effective date.
