AMENDED
public cold plunge; rules; exemption
Purpose
Excludes single-user public or semipublic cold plunges from rules adopted by the Arizona Department of Environmental Quality (ADEQ) governing water pollution in public or semipublic swimming pools and bathing places.
Background
ADEQ is established to 1) formulate policies, plans and programs for the protection of the environment; 2) conduct research on its own initiative or at the request of the Governor, the Legislature or state or local agencies pertaining to its objectives; and 3) provide information and advice on request of any local, state or federal agencies and private persons and businesses on matters within its scope; and 4) promote and coordinate the protection and enhancement of the quality of air and water resources consistent with the environmental policy of Arizona.
The Director of ADEQ (Director) must prescribe reasonably necessary measures to prevent deleterious conditions or pollution of water used in public or semipublic swimming pools and bathing places. The rules must prescribe minimum standards for the design of and for sanitary conditions at any public or semipublic swimming pool or bathing place and provide for abatement as public nuisances of premises and facilities that do not comply with the minimum standards. The rules must be developed in cooperation with the Director of the Department of Health Services (DHS) and be consistent with the rules adopted by DHS for public and semipublic swimming pools and bathing places (A.R.S. § 49-104).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Exempts single-user public or semipublic cold plunges from rules adopted by the Director regarding the prevention of water pollution and deleterious conditions in public or semipublic swimming pools and bathing places.
2. Makes technical changes.
3. Becomes effective on the general effective date.
Amendments Adopted by Committee
· Removes the authorization for the Director to adopt rules governing the sanitary conditions of single-user public or semipublic cold plunges.
