ARIZONA STATE SENATE

Fifty-Seventh Legislature, Second Regular Session

FACT SHEET FOR H.B. 2411

coerced abortion; abortion-inducing drugs

Purpose

Establishes the criminal classification of coerced abortion, which a person commits by knowingly administering an abortion-inducing drug to a pregnant woman without her consent with intent to cause an abortion. Classifies a violation as a class 2 felony.

Background

Abortion-inducing drugs may only be provided by qualified physicians in accordance with statutory requirements and manufacturers, suppliers and physicians may not provide abortion-inducing drugs by courier, delivery or mail service. These prohibitions do not apply to drugs that may be known to cause an abortion but that are prescribed for other medical indications (A.R.S. § 36-2160).

A class 2 felony carries a presumptive sentence of seven years for first time offenders and a fine of not more than $150,000 (A.R.S. §§ 13-702 and 13-801).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.
