aviation surveillance technology; fees; prohibition

Purpose

Prohibits the calculation, generation or collection of fees from an aircraft owner or operator based on information that is collected or broadcast by an automatic dependent surveillance-broadcast system (ADS-B system).

Background

ADS-B is a surveillance technology that combines an aircraft's positioning source, aircraft avionics and ground infrastructure to create an accurate surveillance interface between the aircraft and air traffic control. ADS-B consists of ADS-B Out and ADS-B In services. ADS-B Out broadcasts information regarding an aircraft's GPS location, altitude, ground speed and other data to ground stations and other aircraft once per second. ADS-B In provides operators of properly equipped aircraft with weather and traffic position information (U.S. Federal Aviation Administration).

The Director of the Arizona Department of Transportation (ADOT) may establish fees for the use of state-owned airports and related facilities, including: 1) landing and takeoff for commercial aircraft; 2) aircraft tiedown; 3) equipment use; 4) facility use; 5) damages to equipment or facilities; and 6) aircraft servicing. Additionally, the governing body of a city or town or the county board of supervisors may adopt rules and establish fees or charges for the use of airport facilities (A.R.S. §§ 28-8204 and 28-8419).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Prohibits the State, political subdivisions and private entities from using any surveillance equipment or information that is broadcast or collected by an ADS-B system to calculate, generate or collect fees from an aircraft owner or operator.

2.   Defines ADS-B system as aviation surveillance technology that uses any combination of an aircraft's positioning system, aircraft avionics and ground infrastructure to create a surveillance interface between an aircraft and air traffic control or other aircraft, including in and out signals.

3.   Becomes effective on the general effective date.
