vaccination mandates; masks; prohibition

Purpose

            Prohibits governmental entities and businesses from imposing a mask, face covering or vaccination requirement on any Arizona resident.

Background

            Governmental entities are prohibited from imposing a requirement to: 1) wear a mask or face covering anywhere on the governmental entity's premises, except in the case of special health care districts and for long-standing workplace safety and infection control measures unrelated to COVID-19; and 2) receive a vaccination for COVID-19 or any COVID-19 variant, except in a health care institution that is owned or operated by a government entity. Additionally, businesses are not required to enforce any mask mandate imposed on patrons by an Arizona jurisdiction.

A governmental entity is the state or any political subdivision of the state that receives and uses state tax revenues (A.R.S. §§ 36-681; 36-685; and 44-7951).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1. Prohibits a governmental entity from requiring an Arizona resident to wear a mask or face covering regardless of whether the person is on governmental premises.

2. Removes the exemptions from the prohibitions on governmental entity face mask and vaccination requirements for special health care districts and health care institutions owned or operated by a government entity, respectively.

3. Expands, notwithstanding any other law, the prohibition on governmental entity vaccination mandates to apply to vaccinations for any disease or virus, rather than only COVID-19.

4. Prohibits a business from requiring a mask, face covering or vaccination as a condition of entry or employment, except for long-standing workplace safety or infection control measures.

5. Makes technical and conforming changes.

6. Becomes effective on the general effective date.
