FACT SHEET FOR S.B. 1762

 

state land auction; park; appropriation

Purpose

Appropriates an unspecified amount from the state General Fund (state GF) in FY 2027 to the Arizona Department of Administration (ADOA) to distribute to Yuma County for the purchase of a parcel of state land and to form a county park or state park in collaboration with the Arizona State Parks Board (ASPB).

Background

The ASPB consists of seven members with one member being the Arizona State Land Commissioner (Commissioner). The remaining members must be Arizona residents appointed by the Governor. The appointive members must have knowledge of and interest in outdoor activities, multiple uses of lands, archaeology, natural resources and the value of the historical aspects of Arizona, and because of their interest in the conservation of natural resources. The ASPB must have at least one appointive member that is: 1) a representative of the livestock industry;
2) professionally engaged in general recreation work; and 3) professionally engaged in the tourism industry (‎A.R.S. § 41-511).

The Arizona State Land Department (ASLD) must order the sale of the lands to the highest and best bidder at public auction held at the county seat of the county in which the land or the major portion of the land is located and give notice of the sale by advertisement. The ASLD may accept bids offered through electronic means during a public auction. After an accepted bid, the ASLD is not liable for: 1) the failure of a person's electronic means that prevents the person from participating in the auction; or 2) the failure of the electronic means the ASLD operates that is caused by an act of god or nature, a superior or overpowering force or an event or effect that cannot be reasonably anticipated or controlled during or directly preceding the public auction that prevents a person from participating in the public auction. If the Commissioner receives information that indicates there is a change in the circumstances regarding the benefits to the trust before the acceptance of a final bid at the public auction, the Commissioner may cancel the sale proceedings. A person adversely affected by a decision to terminate a sale may appeal such decision to the ASLD Board of Appeals, except for in the prescribed situations in which the ASLD is not liable (‎A.R.S. § 37-236).

            S.B. 1762 appropriates an unspecified amount from the state GF in FY 2027 to ADOA.

Provisions

1.   Appropriates an unspecified amount from the state GF in FY 2027 to ADOA to distribute to Yuma County for the purchase of a parcel of state land and to form a county park or state park in collaboration with the ASPB.

2.   Requires the Arizona State Land Department to collaborate with stakeholders in a county with a population between 200,000 and 250,000 persons to place for sale at public auction a parcel of state trust land that is located within such a county to form a state or county park.

3.   Exempts the appropriation from lapsing.

4.   Becomes effective on the general effective date.
