military compatibility permit zoning
Purpose
Expands the definition of business area to include an area that was not primarily created to allow outdoor advertising structures and is allowed under a military compatibility permit for commercial and industrial uses.
Background
Outdoor advertising signs, displays and devices lawfully
placed in business areas may be placed or maintained along an interstate,
secondary or primary system within 660 feet of the edge of the right-of-way and
must comply with prescribed outdoor advertising standards (A.R.S.
§§ 28-7902
and 28-7905).
For the purposes of highway advertising regulation, a business area is outside municipal limits, embraces all of the land on the same side of the highway on which one or more commercial or industrial activities are conducted, including all land within 1,000 feet measured in any direction from the nearest edge of the actual land used or occupied for such activity, its parking, storage and service areas, its driveways and its established front, rear and side yards, that constitutes an integral part of such activity and that is zoned, under authority of law, primarily to allow industrial or commercial activity. If one or more commercial or industrial activities are located within 1,000 feet of a freeway interchange, the business area must extend 3,000 feet measured in each direction parallel to the freeway from the center line of the crossroad and may not extend beyond the limits of the established commercial or industrial zone (A.R.S. § 28-7901).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Modifies the definition of business area to add, as an alternative to an area zoned primarily for industrial or commercial activity, an area that is allowed pursuant to a military compatibility permit for commercial and industrial uses and was not primarily created to allow outdoor advertising structures.
2. Makes technical and conforming changes.
3. Becomes effective on the general effective date.
