SCR 1005: elections; foreign contributions; prohibition

Overview
Subject to voter approval, prohibits foreign nationals from making and prohibits outlined entities from accepting from a foreign national any contributions that would influence the outcome of ballot measures in Arizona elections.
History
Currently, a campaign finance report must disclose all contributions from: 1) in-state individuals whose contributions exceed $100 for that election cycle, including identification of the contributor's occupation and employer; 2) out-of-state individuals, including identification of the contributor's occupation and employer; 3) candidate committees; 4) political action committees; 5) political parties; and 6) partnerships (A.R.S § 16-926).
Federally, it is illegal for a foreign national to directly or indirectly make, and a person to accept, solicit or receive from a foreign national: 1) a contribution or donation of money or other thing of value; 2) an express or implied promise to make a contribution or donation, in connection with a federal, state or local election; or 3) a contribution or donation to a committee of a political party (52 U.S.C. § 30121).
Provisions
1. Prohibits a foreign national from giving, and prohibits a person, entity or committee from accepting or using from a foreign national, any monies or in-kind goods or services to influence an outcome of an election on a ballot measure, a question, an issue or proposition or an initiative or referendum measure. (Sec. 1)
2. Requires a person, entity or committee that is required to file a campaign finance report to certify in the report under penalty of perjury that the person, entity or committee has not accepted or used monies or in-kind goods or services from a foreign national as prohibited by the act. (Sec. 1)
3. Exempts federally recognized sovereign tribal nations from the prohibition. (Sec. 1)
4. Defines foreign national. (Sec. 1)
5. Instructs the Secretary of State to submit this proposition to the voters at the next general election. (Sec. 1)
