SB 1537: peace officer fund; commission; repeal

Overview

Renames the Peace Officer Training Equipment Fund (Fund) as the Public Safety De-Escalation and Life Safety Fund and repeals the advisory commission of the Fund.

History

Laws 2018, Chapter 312 created the Fund to serve as a source of funding for peace officer equipment. The State Treasurer administers the Fund and is required to invest and divest monies in the Fund and credit its investment earnings back to the Fund. Monies in the Fund are exempt from lapsing and are subject to legislative appropriation (A.R.S. § 41-1731).

The Fund consists of monies deposited from penalty assessments imposed on civil traffic violations and fines, penalties or forfeitures for a criminal violation of the motor vehicle statutes. Monies collected from a surcharge on the fees charged by a court-authorized diversion or defensive driving school program are also deposited into the Fund. Each penalty assessment is $4 and is remitted to the State Treasurer for deposit into the Fund, whereas each surcharge is $9 and is remitted to the Supreme Court for a $4 deposit into the Fund and a $5 deposit into the Judicial Collection Enhancement Fund (A.R.S. §§ 12-114; 12-116.10).

The advisory commission of the Fund consists of seven members who serve three-year terms. All members are appointed by either the Legislature or by various state law enforcement associations, except for the Director of the Department of Public Safety. By December 1 of each year, the commission is required to submit written recommendations on the allocation of monies in the Fund to the Legislature; the Chairpersons of the Senate Commerce and Public Safety committees; and the House Judiciary and Public Safety committees (A.R.S. § 41-1732).
