Summary of the Strike-Everything Amendment to SB1531

Overview

Ensures an injured employee has the choice of medical, surgical and hospital benefits and prevents any related party from circumventing or undermining an injured employee's choice of a provider.

History

Currently, on notice to the employer, every injured employee is allowed access to medical, surgical and hospital benefits, nursing, medicine, crutches and other apparatus that are reasonably required at the time of the injury and during the period of disability. This is deemed medical, surgical and hospital benefits (A.R.S. § 23-1062).

If an insurance carrier or self-insured employer receives written notification of an injury from an employee who was injured and intends to file a claim for compensation, the insurance carrier or self-insured employer must forward the written notification of the injury and intended claim for compensation to the Industrial Commission of Arizona (Commission) within seven business days and inform the employee of the employee's requirement to file a claim with the Commission. Any claims must be filed within one year of the injury (A.R.S. § 23-1061).

Provisions

1.   Allows an injured employee to choose the following when related to medical, surgical and hospital benefits:

a.   the medical provider;

b.   the pharmacy that provides prescription drugs; and

c. any ancillary services that include;

i. laboratory services;

ii.   imaging services; and

iii.  durable medical equipment. (Sec. 1)

2.   Prohibits an insurer, pharmacy benefits manager, employer or an agent or representative of the insurer, pharmacy benefits manager or employer from undermining or ignoring the injured employee's choice of a provider. (Sec. 1)
