SB 1501: agencies; statutory authority

Overview
Permits an individual to file a complaint with the Administrative Rules Oversight Committee (Committee) regarding existing statute or practices that are alleged to constitute a rule or substantive policy statement that is alleged to be beyond an agency's statutory authority.
History
Statute states that to ensure fair and open regulation by state agencies, an individual can file a complaint with the Committee concerning an existing statute, rule or practice alleged to be duplicative or onerous. The Committee receives such complaints and can review them, hold hearings and comment to an agency, the Attorney General (AG), the Governor's Regulatory Review Council (Council) or the Legislature on whether the statute or practice alleged to constitute rules or substantive policy statements is beyond the agency's statutory authority (A.R.S. §§ 41-1001.01, 41-1048).
The Committee consists of: 1) five members of the House of Representatives, appointed by the Speaker of the House of Representatives; 2) five members of the Senate, appointed by the President of the Senate; and 3) the Governor or their designee. No more than three members of each chamber may be members of the same political party, and the Governor may not appoint a designee who is not an appointed agency director (A.R.S. § 41-1046).
Provisions
1. Allows an individual to file a complaint with the Committee concerning existing statute, rule or practice that is alleged to constitute a rule or substantive policy statement that is alleged to be beyond an agency's statutory authority. (Sec. 1)
2. Requires the Committee to receive such complaints. (Sec. 2)
3. Permits the Committee to review such complaints, hold hearings and comment to an agency, the AG, the Council or the Legislature on whether the statute, rule or practice is beyond the agency's statutory authority and include recommendations for alleviating the aspects beyond the agency's statutory authority. (Sec. 2)
4. Instructs the Committee to include in their annual report to the Legislature, their recommended legislation to alleviate the effects of the statutes, rules or agency practices alleged to constitute rule and substantive policy statements that are beyond an agency's statutory authority. (Sec. 2)
5. Makes technical changes. (Sec. 1, 2)
