Summary of Strike-Everything Amendment to SB 1176

Overview

Prohibits a person from lobbying the Legislature on behalf of a city, town or county unless the city, town or county's governing body has adopted a formal position on the legislative matter that meets specified requirements.

History

Lobbying means attempting to influence the passage or defeat of any legislation by directly communicating with any legislator or attempting to influence any formal rulemaking proceeding. Arizona regulates lobbying through statutory requirements for registration, reporting and disclosure. This includes provisions governing public bodies that employ or designate lobbyists (A.R.S § 41-1231).

Provisions

1.   Prohibits a person from lobbying the legislature on behalf of a city, town or county unless the city, town or county's governing body has adopted a formal position on the legislative matter at issue. (Sec. 1)

2.   Requires that the formal position:

a.   is approved by a majority vote of the governing body;

b.   is adopted before any lobbying activity occurs;

c. clearly states the position on the specific legislative matter, including whether the city, town or county supports, opposes or is neutral; and

d.   is documented in the official minutes or other public record of the city, town or county. (Sec. 1)

3.   Specifies that the requirements apply to a person required to be registered as a designated or authorized public lobbyist for a city, town or county. (Sec. 1)

4.   States a person is not prohibited from providing neutral and factual information in response or communications with the Legislature or advocating a formal position as expressly authorized by a legislative agenda or policy statement adopted by a governing body. (Sec. 1)

5.   States that a person who violates this section may not represent that the person is acting on behalf of the city, town or county. (Sec. 1)
