SB 1128: study committee; scrap metal theft

Overview
Establishes the Scrap Metal Theft Study Committee (Study Committee).
History
Statute regulates scrap metal dealers and prohibits cities, towns and counties from enacting or enforcing ordinances, rules or regulations that conflict with statute. A dealer is a person or business entity, except licensed automotive recyclers, that is engaged in the business of purchasing, trading, bartering or otherwise receiving secondhand or castoff material, commonly known as scrap metal. Scrap metal dealers must register with the Department of Public Safety and update registration information every two years (A.R.S. § 44-1641).
Provisions
1. Establishes the 7-member Study Committee and outlines the committee membership. (Sec. 1)
2. Prescribes duties for the Study Committee including:
a. determining whether scrap metal dealer statutes deter crime;
b. evaluating the scrap metal industry's cost spent for complying with scrap metal statutes;
c. reviewing scrap metal statutes and other related to statutes to determine the effectiveness of existing penalties and fines; and
d. submitting a report of findings and recommendations by December 1, 2026. (Sec. 1)
3. Repeals the Study Committee on December 31, 2026. (Sec. 1)
