SB 1003: elections; canvass; certification; acknowledgment

Overview

Requires a governing body holding an election and the Secretary of State to acknowledge without prejudice the canvass of an election. Directs elections and tabulation officers to make outlined certifications under oath to the applicable governing board holding an election.

History

A governing body holding a primary election is required to meet and canvass the election not later than the second Monday after the election. For a general election, a governing body is required to meet and canvass the election not later than the third Thursday after the election.

The Secretary of State (SOS) is required to canvass primary election results not later than the third Thursday after the election and general election results not later than the third Monday after the election. The governing body of a city, town or special district must meet and canvass the election not less than 6 days and not more than 20 days following the election. The governing body of a special taxing district is required to present to the applicable county Board of Supervisors (BOS) a certified copy of the official canvass of the election at the next regularly scheduled meeting of the county BOS (A.R.S. § 16-642).

Provisions

1.   Requires a governing body holding an election to meet and acknowledge without prejudice the canvass of an election as outlined. (Sec. 1)

2.   Directs the officer who conducts an election to certify its accuracy under oath and the officer who tabulates ballots to certify the results under oath to the applicable governing board of a municipality, county or special taxing district. (Sec. 1)

3.   Instructs the SOS to acknowledge without prejudice the canvass of the election as outlined. (Sec. 1)

4.   Requires a governing body of a special taxing district to present to the applicable county BOS a certified copy and an acknowledgement without prejudice of the official canvass of the election at the next regularly scheduled meeting of the applicable county BOS. (Sec. 1)

5.   Requires that an official canvass include a copy of the sworn statements of the applicable elections and tabulation officers and the governing body's acknowledgement without prejudice as prescribed by the act. (Sec. 3)

6.   Requires that a governing body's acknowledgement without prejudice and a copy of its elections and tabulation officers' sworn statements be filed with the appropriate city or town clerk, or, in a special taxing district election, with the clerk of the applicable county BOS. (Sec. 3)
