HCR 2001: citizenship; identification; contributions; early voting

Overview
Subject to voter approval, establishes election requirements that limit voting in Arizona elections to United States citizens, prohibits foreign contributions to candidate and ballot measure campaigns and requires government-issued identification to vote. Requires that all voters be provided the option to have their ballot tabulated at their voting location. Applies the provisions of the act to elections beginning in 2028.
History
Voter eligibility in Arizona elections is governed by statute and requires an individual seeking to register to vote to meet six qualifications. A registrant must: 1) be a citizen of the United States and provide satisfactory evidence of citizenship; 2) be at least 18 years of age on or before the date of the next regular general election following registration; 3) have been a resident of Arizona for at least 29 days preceding the election, subject to limited statutory exceptions; 4) be able to write the registrant’s name or make a mark, unless prevented by a physical disability; 5) not have been convicted of treason or a felony unless civil rights have been restored; and 6) not have been adjudicated an incapacitated person under state law. These statutory qualifications determine who may register to vote and participate in Arizona elections. (A.R.S. § 16-101).
Arizona elections are administered by counties through in-person voting on election day, early voting and mail-in voting, including the operation of polling places and voting centers and the verification of voter identification at the time a ballot is cast. Statute governs early voting timelines, mail-in ballot procedures and election administration, while federal law regulates campaign contributions involving foreign nationals. (A.R.S. § 16-411) (52 U.S.C. § 30121).
Provisions
1. Allows only citizens to register and vote in Arizona elections.
2. Prohibits foreign nationals from contributing or expending money or anything of value to influence an Arizona election and prohibits any person from knowingly accepting such a contribution.
3. Requires every voter to show valid government issued proof of identity before casting a ballot in each election, whether voting in person or by any other method, as prescribed by law.
4. Requires that Arizona elections be decided solely by the votes of eligible citizen voters.
5. Mandates that all voters be provided the option to have their ballot tabulated at their voting location, as prescribed by law.
6. Allows the people and the legislature to enact laws governing elections, provided such laws are rationally connected to a legitimate state interest, as outlined.
7. Directs the legislature to appropriate any monies necessary to implement the provisions of the act.
8. Exempts the act from requirements in the Arizona Constitution relating to expenditures required by initiative or referendum.
9. Designates the act as the Fast Accurate Secure Transparent Election Results Act or the FAST Election Results Act.
10. Applies the act to all elections beginning in 2028.
11. Contains a severability clause.
12. Contains a legislative intent clause.
13. Requires the Secretary of State to submit the proposition to the voters at the next general election.
