HCM 2001: Muslim Brotherhood; designation; terrorist organization
Sponsor: Representative Gillette, LD 30
Transmitted to the Secretary of State
Overview
Urges the President of the United States and Congress to designate the Muslim Brotherhood as a foreign terrorist organization.
History
Federal law authorizes the U.S. Secretary of State to designate an organization as a Foreign Terrorist Organization. To make a designation, the Secretary of State must determine that an organization is foreign, engages in terrorist activity or terrorism or retains the capability and intent to engage in such activity and that the organization’s terrorist activity threatens the security of U.S. nationals or the national security of the U.S.
The statute requires advance notification to congressional leadership and publication of the designation in the Federal Register. A designated organization may seek judicial review of the designation in federal court (8 U.S.C. § 1189).
