Overview

Contains provisions relating to criminal justice needed to implement the FY 2027 budget.

History

The Arizona Legislature adopts a budget for each fiscal year (FY) that contains general appropriations. Article IV, Section 20, Part 2 of the Constitution of Arizona requires the General Appropriations Act (feed bill) to contain only appropriations for the different state departments, state institutions, public schools and interest on public debt. Statutory changes necessary to reconcile the appropriations made in the feed bill and other changes are drafted into separate budget bills. These bills are prepared according to subject area.

Provisions

State Prison Transition Program (Program)

1.   Combines two separate Program reports, relating to inmate program participation and cost reductions, into a single consolidated report. (Sec. 1, 3)

2.   Requires the aforesaid report to be submitted annually on November 30, rather than July 31, to the Director of the Joint Legislative Budget Committee, in addition to the Governor, Secretary of State and members of the Legislature. (Sec. 1)

Erroneous Convictions Fund

3.   Prohibits any State agency, board, commission or department from using monies from any fund or source other than the Erroneous Convictions Fund to pay any reimbursement or compensation awarded to a claimant who was erroneously convicted. (Sec. 4)

4.   Specifies the State is not liable for payment of any reimbursement or compensation that exceeds the monies available in the Fund. (Sec. 4)

5.   Applies retroactively beginning January 1, 2026, the prohibition on the use of monies from any fund other than from the Erroneous Convictions Fund for erroneous conviction reimbursements, and the State's non-liability for payments that exceed monies available in the Fund. (Sec. 11)

Corrections Fund

6.   Increases the amount to be transferred annually from the Corrections Fund to the DOC Building Renewal Fund by the Director, from $2,500,000 to $12,500,000. (Sec. 8)

 

Civil Rights Division

7.   Repeals the statute establishing the Civil Rights Division and Advisory Board. (Sec. 6)

8.   Establishes the Civil Rights Division within the Department of Law. (Sec. 7)

9.   Repeals the statute terminating the Civil Rights Advisory Board and Civil Rights Division on July 1, 2026, and on January 1, 2027, respectively. (Sec. 9)

10.  Defines division as the Civil Rights Division within the Department of Law. (Sec. 7)

Miscellaneous

11.  Directs the Department of Public Safety to establish the Major Incident Division on July 1, 2028, rather than July 1, 2027. (Sec. 10)
