The House Engrossed version of HB 2873 creates a mandatory question and answer period for the Arizona Department of Administration's competitive sealed bidding process.

The Senate adopted a strike-everything amendment that does the following:

Overview

Contains an emergency measure that permits a person or organization to withdraw their referendum petition by filing a written notice of withdrawal before the measure has qualified for the ballot.

History

The whole number of votes cast at a municipal election at which a mayor or council members were chosen last preceding the submission of the application for a referendum petition against an ordinance, franchise or resolution must be the basis on which the number of electors of the municipality required to file a referendum petition must be computed. The petition must be filed with the municipal clerk within 30 days after passage of the ordinance, resolution or franchise (A.R.S. § 19-142).

Provisions

1.   Allows a person or organization that files a referendum petition with a municipality clerk to withdraw the referendum petition by filing a written notice of withdrawal with the municipality clerk at any time before the measure has qualified for the ballot. (Sec. 1)

2.   Stipulates that this act applies retroactively to all written notices of withdrawal that are filed with a municipality clerk by December 31, 2025, regardless of whether the referendum's acceptance or rejection. (Sec. 3)

3.   Prohibits votes for a municipality referendum for which a written notice of withdrawal has been filed by December 31, 2025, from being tallied or canvassed. (Sec. 3)

4.   Repeals this legislation on July 31, 2027. (Sec. 2)

5.   Contains an emergency clause. (Sec. 4)
