Overview

Adjusts the required characteristics of representatives who are requested to be present at a law enforcement officer's administrative investigation interview.

History

Through the course of an administrative investigation where an employer interviews a law enforcement officer and the officer reasonably believes that the interview could result in dismissal, demotion or suspension, the officer has the right to request a representative to be present during the interview, but only as an observer. The representative must be from the same agency and can not be an attorney, unless the employer gives permission for the representative to be otherwise. It is also required of the law enforcement officer, if the officer requests a representative, to select a representative who is available on reasonable notice to not unreasonably delay the interview. Additionally, it is specified that a representative's presence during the interview creates no additional cost for the employer (A.R.S. § 38-1104).
