HB 2426: state land department; disposition plan

Overview
Directs the Arizona State Land Commissioner to complete the five-year disposition plan (Disposition Plan) and conceptual land use plan (Conceptual Plan) for state lands and adopt relevant policies for implementation by June 30, 2029.
History
The Arizona State Land Commissioner's (Commissioner) duties include making plans for the future use of state lands in cooperation with other state agencies, local planning authorities and political subdivisions to promote the infill and orderly development of state lands in areas beneficial to the trust and to prevent urban sprawl.
The Disposition Plan identifies the land projected to be sold, leased, reclassified for conservation purposes, master planned or zoned during the next five years.
The Conceptual Plan is developed for urban state trust land and other state trust lands that identifies appropriate use, transportation corridors and infrastructure requirements and all natural and artificial constraints and opportunities (A.R.S. §§ 37-132, 37-331.03).
Provisions
1. Instructs the Commissioner to complete the following within two years of the effective date of this act:
a. complete the Disposition Plan for state lands;
b. update the Conceptual Plan;
c. adopt written policies and procedures:
i. for updating the Disposition Plan every five years;
ii. for updating the Conceptual Plan every ten years;
iii. on how the State Land Department will use the Conceptual Plan and Disposition Plan for determining if State Trust lands are or will be sent to public auction; and
d. provide a copy of the Conceptual Plan, Disposition Plan and the policies and procedures adopted to the President of the Senate and the Speaker of the House of Representatives. (Sec. 1, 2)
2. Requires the Commissioner to:
a. approve Conceptual Plans that the Commissioner deems appropriate;
b. issue a written order approving each Conceptual Plan, Disposition Plan and revision; and
c. make each Conceptual Plan, Disposition Plan, revision and written approval of each plan available to the public on the State Land Department's website, ensuring the Disposition Plan conforms with the Conceptual Plan. (Sec. 1, 2)
3. Stipulates that the Conceptual Plan, as applied to state lands that have not been annexed as of the effective date, is the controlling land use designation for state lands and supersedes any conflicting municipal or county zoning on the approval of the Conceptual Plan. (Sec. 1)
4. Repeals this legislation on June 30, 2029. (Sec. 2)
5. Contains a legislative findings clause. (Sec. 3)
6. Makes technical and conforming changes. (Sec. 1, 2)
