Overview

Mandates that a citation, issued for a civil traffic violation or a misdemeanor criminal offense relating to transportation regulation, must be signed by the presiding judge of the court that is adjudicating the citation. Asserts that a citation not signed by the presiding judge is void. Directs the court to notify the charged person of the void citation.

History

Municipal and justice courts have concurrent jurisdiction over all civil and misdemeanor criminal violations and over class 2 and 3 misdemeanor criminal violations in aviation that are committed by persons 18 years or older. Municipal and justice courts have concurrent jurisdiction over civil traffic violations committed within their boundaries by persons under 18 years of age if the presiding judge of the superior court in the county declined jurisdiction relating to juvenile court laws (A.R.S. § 28-1552).

Provisions

1.   Requires that a citation, issued because of a civil traffic violation or a misdemeanor criminal offense under transportation regulation and that is generated by a photo enforcement system, must be signed by the presiding judge of the court that is adjudicating the citation. (Sec. 1)

2.   Allows the presiding judge to sign the citation electronically. (Sec. 1)

3.   Stipulates that if the citation is not signed by the presiding judge, the citation must be dismissed and the court must notify the person charged with the violation or offense of the dismissed citation because the presiding judge did not sign the citation. (Sec. 1)

Senate Amendments

1.   Requires the citation to be signed by the mayor of the municipality, rather than the presiding judge of the court that is adjudicating the citation.
