HB 2257: HOV lane; blood transport vehicles

Overview
Authorizes blood transport vehicle to use the high occupancy vehicle (HOV) lane if it is not deemed by the Arizona Department of Transportation (ADOT) to degrade the lane. Defines blood transport vehicle.
History
A person must not drive a vehicle carrying fewer than two persons, including the driver, in a HOV lane any time the HOV lane is restricted to vehicles carrying two or more persons, including the driver, except: 1) a tow truck operator during the performance of a tow truck operator's duties,; 2) a person driving a motorcycle; 3) a person driving a public transportation vehicle; and 4) an authorized emergency vehicle in use by a first responder in the line of duty. (A.R.S. § 28-737)
ADOT must develop procedures to monitor the impact that single occupancy vehicles have on the operation of HOV lanes. If an HOV lane becomes degraded due to the authorization of a single occupancy vehicle, the use of the lane is restricted in the following priority: 1) passenger vehicles with two or more occupants, including the driver; 2) public transit buses; 3) buses with two or more occupants, including the driver; 4) motorcycles; 5) alternative fuel vehicles; and 6) low emission and energy efficient vehicles. (A.R.S. § 28-337)
Provisions
1. Allows blood transport vehicles to use the HOV lane if the vehicle displays on each side and on the rear of the vehicle a removable sign or decal indicating the vehicle is transporting human blood or blood products. (Sec. 2)
2. Restricts blood transport vehicles from using the HOV lane if ADOT deems them to degrade the lane. (Sec. 1)
3. Defines blood transport vehicle as a motor vehicle that is owned or operated by a nonprofit general blood banking operation, a nonprofit blood bank or a nonprofit blood bank's agent and that is transporting blood or blood products between collection points, hospitals or blood storage centers. (Sec. 2)
4. Makes technical and conforming changes. (Sec. 1, 2)
