HB 2110: school governing bodies; meetings; prayer

Overview
Mandates the deliberative governing body of a public school or public educational institution (deliberative governing body) allow a deliberative governing body member to provide an invocation for a meeting.
History
A school district, a charter school, an accommodation school and the Arizona State Schools for the Deaf and the Blind (ASDB) may not discriminate against parents or students based on a religious viewpoint or religious expression. Students in these public educational institutions may pray or engage in religious activities or religious expression before, during and after the school day in the same manner and to the same extent that students may engage in nonreligious activities or expression. The state nor its political subdivisions may require any person to participate in prayer or other religious activity (A.R.S. § 15-110).
Provisions
1. Requires a deliberative governing body to allow any member of the deliberative governing body, on request from the member, to provide an invocation for a meeting if the member makes the request to the presiding officer at least 48 hours before the meeting is scheduled to begin. (Sec. 1)
2. Lists the entity that is the deliberative governing body of a school district, charter school, career technical education district, community college district, public university and ASDB. (Sec. 1)
3. Prohibits a deliberative governing body member from providing an invocation that:
a. is exploited to proselytize or advance or to disparage any faith or belief; or
b. coerces participation by observers of the invocation. (Sec. 1)
4. Defines invocation as a prayer or invocation that is delivered to open a meeting of a deliberative governing body. (Sec. 1)
5. Contains a legislative findings clause. (Sec. 2)
