Overview
Establishes the Childhood Cancer and Rare Childhood Disease Research Commission (Commission) under the Arizona Department of Health Services (DHS) to award grants to health care providers and research institutions engaged in clinical trials relating to research on pediatric cancer or other rare pediatric diseases. Outlines membership, duties and reporting requirements.
History
The Childhood Cancer and Rare Childhood Disease Research Fund (CCRDF) was established to support childhood cancer research. The DHS Director administers CCRDF and annually distributes CCRDF monies to health care providers and research institutions that are in Arizona, are nonprofit organizations and engaged in phase I clinical trials relating to research on pediatric cancer or other rare pediatric disease.
Currently, CCRDF consists of monies from special plate fees and renewals. Of the $25 fee, $8 is for administrative costs deposited to the State Highway Fund and $17 is deposited to CCRDF. Not more than 10% of monies deposited in the fund annually can be used for the cost of administering the fund (A.R.S. §§ 36-121 and 28-2442).
Childhood Cancer and Rare Childhood Disease Research Commission
1. Establishes the Commission, consisting of members appointed by the Director of DHS, including at least the following:
a. one member who is a survivor of childhood cancer or a caregiver to individuals who have childhood cancer;
b. one member who is a survivor of a rare childhood disease or the caregiver to individuals who have rare childhood diseases;
c. four health professionals who practice in the field of pediatric cancer or rare childhood diseases; and
d. one representative of a nationwide pediatric cancer advocacy nonprofit organization. (Sec. 2)
2. Requires Commission members to serve five-year terms and annually elect a chairperson from the membership. (Sec. 2)
3. Specifies that Commission members are not eligible to receive compensation but are eligible for reimbursement of expenses. (Sec. 2)
4. Requires the Commission to:
a. establish criteria for the clinical trials that qualify to receive research grants;
b. oversee the application process and review applications for the clinical trial research grants to assist the DHS Director in selecting the most credible clinical trials to which to award the research grants; and
c. ensure that all Commission meetings are open to the public and allow for public testimony. (Sec. 2)
5. Requires the Director of DHS to award grants to Arizona nonprofit health care providers and research institutions that are engaged in clinical trials relating to research on pediatric cancer or other rare pediatric diseases. (Sec. 2)
6. Allows monies to be used in a collaborative study or research program with other out-of-state facilities. (Sec. 2)
7. Requires nonprofit organizations that receive CCRDF monies to only be used for the prescribed purposes even if the monies are aggregated with other monies. (Sec. 2)
8. Requires Commission members to recuse themselves from discussing and voting on any matter in which they have a conflict of interest. (Sec. 2)
9. Allows the following persons to serve as a Commission member on any grant application if a Commission member recuses themselves due to a conflict of interest and the Commission no longer has a quorum:
a. the Commission Director;
b. the Commission's Director designee; or
c. other DHS staff members appointed by the Director. (Sec. 2)
10. Directs the Commission to submit a report no later than August 1, 2027, and annually thereafter to the Appropriations Committees and Health and Human Services Committees of the Arizona State Senate and Arizona House of Representatives detailing the number, amounts and recipients of the grants awarded, the resulting research, return on investment and any other relevant information. (Sec. 2)

11. Authorizes the DHS Director to allocate monies from CCRDF for grants awarded by the Commission. (Sec.1)
12. Adds that CCRDF consists of monies received from legislative appropriations, gifts, donations and federal grants. (Sec. 1)
13. Specifies that the allocation of monies for the grants is subject to legislative appropriation, award of federal grants or a combination of both, in an amount of at least $5,000,000 for the purposes of childhood cancer and rare childhood diseases. (Sec. 1)
14. Allows the DHS Director to use up to 4% of the amount appropriated or granted for administrative costs, unless otherwise specified by the federal grant contract. (Sec. 1)
15. Requires the DHS Director to allocate monies received from issuing childhood cancer research special plates, if DHS does not receive additional legislative appropriations, federal grants or a combination of both, as specified. (Sec. 1)
16. Authorizes nonprofit organizations that receive monies from the CCRDF to use the monies for the prescribed purposes even if the monies are aggregated with other monies. (Sec. 1)
17. Allows monies allocated by the Director of DHS to be used in a collaborative study or research program with other, out-of-state facilities. (Sec. 1)
