Description

The bill would require the Arizona Health Care Cost Containment System (AHCCCS) by March 30th to annually request a section 1115 waiver from the federal Centers for Medicare and Medicaid Services (CMS) to cover any AHCCCS-covered services that were eliminated or reduced in the state plan on or after September 2010 if the services are provided by an Indian Health Service (IHS) or Tribal 638 facility.

 

Estimated Impact

AHCCCS estimates the bill would not have an impact on current coverage levels for tribal members receiving services at an IHS/638 facility. Under current AHCCCS rules and waiver authority, post-September 2010 coverage limitations already do not apply in these cases.

 

Analysis

During the Great Recession in 2010, the Legislature limited/eliminated several AHCCCS-covered benefits, including most dental services. However, coverage levels have since been gradually restored, particularly in the case of the American Indian Health Program.

 

AHCCCS' current rules and 1115 waiver authority exclude post-September 2010 coverage limitations for services delivered to tribal members at IHS/638 facilities (such as preventive dental). These services receive a 100% federal match. Therefore, the bill would not have a fiscal impact.
