A CONCURRENT RESOLUTION

 

proposing an amendment to the constitution of Arizona; amending article VIII, part 2, section 2, constitution of arizona; relating to impeachment.

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

1. Article VIII, part 2, section 2, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

START_STATUTE2. Conviction; grounds for impeachment; judgment; liability to trial

Section 2. A. No A person shall not be convicted without a concurrence of two-thirds of the senators elected.

B. The governor and other state and judicial officers, except justices of courts not of record, shall be liable to impeachment for high crimes, misdemeanors, or malfeasance in office any of the following, but judgment in such cases shall extend only to removal from office and disqualification to hold any office of honor, trust or profit in the state:

1. High crimes.

2. Misdemeanors.

3. Malfeasance in office.

4. Failing to follow and enforce a state law or court rule.

C. The party, whether convicted or acquitted, shall, nevertheless, be liable to trial and punishment according to law. END_STATUTE

2. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
