AN ACT
amending sections 9-500.07 and 11-269, Arizona Revised Statutes; amending title 49, chapter 4, article 1, Arizona Revised Statutes, by adding section 49-707; relating to recycling.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 9-500.07, Arizona Revised Statutes, is amended to read:
9-500.07. Recycling and waste reduction; definition
a. A city or town shall provide its residents with an opportunity to engage in recycling and waste reduction.
B. Notwithstanding subsection A of this section, as of the effective date of this amendment to this section, a city or town may not recommend or require that a resident of the city or town place any product in a recycling bin that is not being actively recycled at present time.
C. For the purposes of this section, "actively recycled" means a product that is reprocessed into a new product.
Sec. 2. Section 11-269, Arizona Revised Statutes, is amended to read:
11-269. Recycling and waste reduction; definition
a. A county shall provide its residents with an opportunity to engage in recycling and waste reduction.
B. Notwithstanding subsection A of this section, as of the effective date of this amendment to this section, a county may not recommend or require that a resident of the county place any product in a recycling bin that is not being actively recycled at present time.
C. For the purposes of this section, "actively recycled" means a product that is reprocessed into a new product.
Sec. 3. Title 49, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 49-707, to read:
49-707. Recycling; new recycling materials; prohibition; definition
A. Notwithstanding any other law, as of the effective date of this section, a municipality, county or other political subdivision of this state may not recommend or require that a resident place any product in a recycling bin that is not being actively recycled at present time.
B. For the purposes of this section, "actively recycled" means a product that is reprocessed into a new product.
