AN ACT

 

Amending title 36, chapter 29, article 1, Arizona Revised Statutes, by adding section 36-2903.18; relating to the Arizona health care cost containment system.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2903.18, to read:

START_STATUTE36-2903.18. Health insurance plans; exchange; monthly review for dual enrollment; notice to dual enrollees; definition

A. The administration shall:

1. Contingent on the availability of data provided by the public assistance reporting information system and approval by the centers for medicare and medicaid services, conduct a monthly review to ensure that persons who are enrolled in a health insurance plan that is sold on the federally facilitated exchange pursuant to the affordable care act are not also enrolled in the system.

2. Notify persons who are found to be enrolled in a health insurance plan that is sold on the federally facilitated exchange pursuant to the affordable care act and also enrolled in the system of INFORMATION REGARDING THE POTENTIAL RISKS, CONSEQUENCES AND LIABILITIES ASSOCIATED WITH SIMULTANEOUS ENROLLMENT IN THE SYSTEM AND A HEALTH INSURANCE PLAN that is SOLD ON THE FEDERALLY FACILITATED EXCHANGE.

B. For the purposes of this section, "affordable care act" has the same meaning prescribed in section 1-271. END_STATUTE
