A CONCURRENT RESOLUTION

 

proposing an amendment to the Constitution of Arizona; amending article VII, Constitution of Arizona, by adding section 19; relating to election requirements.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1. Article VII, Constitution of Arizona, is proposed to be amended by adding section 19 as follows if approved by the voters and on proclamation of the Governor:

19. Elections; citizens; foreign national contributions prohibited; identification; early voting; mail-in ballots; severability; effective date

Section 19. A. In addition to any other qualifications prescribed by this Constitution or by law, Only citizens may register and vote in Arizona elections.

B. Foreign nationals may not contribute or expend money or anything of value to influence an Arizona election, and no person may knowingly accept such a contribution.

C. EVERY VOTER MUST SHOW VALID government issued proof of identity before casting a ballot in each election, whether voting in person or by any other method, as prescribed by law.

D. Arizona elections shall be decided solely by the votes of eligible citizen voters.

E. To prevent administrative delays and ensure timely and accurate election results, on election day all voters shall be provided the option to have their ballot tabulated at their voting location, as prescribed by law.

F. THE PEOPLE AND THE LEGISLATURE MAY ENACT LAWS GOVERNING ELECTIONS, INCLUDING EARLY VOTING AND MAIL VOTING, PROVIDED SUCH LAWS ARE RATIONALLY CONNECTED TO A LEGITIMATE STATE INTEREST INCLUDING TIMELY AND ACCURATE ELECTION RESULTS, EFFICIENT ELECTION ADMINISTRATION, ELECTION SECURITY, AND PRESERVING PUBLIC CONFIDENCE IN THE INTEGRITY OF ELECTIONS.

G. If a provision of this act or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of the act that can be given effect without the invalid provision or application, and to this end the provisions of this act are severable.

H. THE LEGISLATURE SHALL APPROPRIATE ANY MONIES NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION.

i. THIS act IS NOT SUBJECT TO THE REQUIREMENTS OF ARTICLE IX, SECTION 23.

J. This ACT applies to all elections taking place on or after January 1st, 2028.

k. This amendment shall commonly be DESIGNATED AND LIKEWISE known as The "fast accurate Secure transparent election results act or the fast election results Act."

2. Intent

Nothing in this measure constitutes a change in the federal law for the UOCAVA process for overseas military voters.

3. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
