Urging the United STates Environmental Protection Agency to waive the federal gas tax in Arizona.

To the Administrator of the United States Environmental Protection Agency and the Congress of the United States of America:

Your memorialist respectfully represents:

Whereas, the State of Arizona has taken large steps toward meeting National Ambient Air Quality Standards (NAAQS) implemented through the Clean Air Act; and

Whereas, through Environmental Protection Agency (EPA) approved State Implementation Plans, Arizona's Cleaner Burning Gas blend has been implemented and sold throughout Maricopa County and Pinal County to meet the NAAQS and to get these regions out of nonattainment; and

Whereas, rising gas prices are a widespread problem across the United States; and

Whereas, the tax on Arizona's Cleaner Burning Gas, a special blend created specifically for Arizona, is taxed at an equal rate as other states that do not have to implement a special blend of gasoline; and

Whereas, Arizona's Cleaner Burning Gas is generally more expensive because its a specialized fuel blend; and

Whereas, eliminating the federal tax on Arizona's Cleaner Burning Gas would help lower gas prices and help the people of Arizona.

Wherefore your memorialist, the House of Representatives of the State of Arizona, the Senate concurring prays:

1. That the Congress of the United States and the EPA either:

(a) Eliminate the federal gas tax on Arizona's Cleaner Burning Gas sold in Maricopa County and Pinal County from May 1 to September 30.

(b) Give the Administrator of the EPA emergency authority to waive the federal gas tax on any EPA-approved gas blend in Arizona that the EPA finds necessary to meet the NAAQS and that is more expensive to produce than conventional gasoline.

2. That the Secretary of State of the State of Arizona transmit copies of this Memorial to the Administrator of the EPA, the President of the United States Senate, the Speaker of the United States House of Representatives and each member of Congress from the State of Arizona.
