An Act
amending title 31, chapter 2, article 2, Arizona Revised Statutes, by adding section 31-243; relating to prisoners.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 31, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 31-243, to read:
31-243. Inmates suffering from terminal condition or disease; release; eligibility; definition
A. The director may release an inmate from custody for placement in a nursing care institution if an inmate either:
1. Suffers from a terminal condition or disease and requires palliative or end-of-life care.
2. Is so debilitated or incapacitated by the terminal condition or disease that the inmate requires continuous care or is physically incapable of presenting a danger to self or others if released.
B. The director shall periodically review the medical records of each inmate who is released from custody pursuant to this section to verify that the inmate continues to meet the eligibility requirements prescribed by this section. If the director determines that an inmate no longer meets the eligibility requirements prescribed by this section, the inmate shall be returned to the custody of the department.
C. an inmate who was convicted of first degree murder pursuant to section 13-1105 is not eligible for release under this section.
D. for the purposes of this section, "nursing care institution" means a nursing care institution as defined in section 36-401 that is under contract with this state or the department.
