ARIZONA STATE SENATE

election mailings; third-party disclosures
Purpose
Requires the words "not from a government agency" to appear on
the outside of an
election-related document that is mailed or hand delivered by any
nongovernmental person or entity.
Background
The Secretary of State (SOS) must make voter registration forms available for distribution through governmental and private entities. Governmental entities such as the county recorder may provide voter registration forms to any qualified person requesting registration information or groups or individuals that request forms for voter registration drives. The county recorder must distribute state mail in registration forms to government locations such as government offices, fire stations and public libraries throughout the county (A.R.S. §§ 16-131 and 16-151).
Within 93 days before any
election, an elector may make a verbal or signed request for an official early
ballot to the county recorder or other officer in charge of elections for the
applicable political subdivision of Arizona in whose jurisdiction the elector
is registered to vote (A.R.S. §
16-542).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires any nongovernmental person or entity that mails or hand delivers an official election-related document, or a document resembling an election-related document, from the county recorder, officer in charge of elections or the SOS, to include the words "not from a government agency" in boldfaced, clearly legible print on the outside of the envelope.
2. Specifies that documents subject to this requirement include a voter registration application or an early ballot request.
3. Becomes effective on the general effective date.
