FACT SHEET FOR S.B. 1541

 

early voting list; ten years

Purpose

Requires a voter to be removed from the Active Early Voting List (AEVL) after 10 years if the voter does not notify the county recorder as prescribed.

Background

Any qualified elector may vote by early ballot by making a request for a one-time early ballot as provided by statute, or by requesting to be on the AEVL which allows a voter to vote by early mail ballot. After a voter has requested to be included on the AEVL they must automatically be sent an early ballot by mail to the voter's address for any election in which the voter is eligible to vote. A voter remains on the AEVl until: 1) the voter requests to be removed from the AEVL in writing; 2) the voter's registration or eligibility for registration is moved to inactive status or canceled as otherwise provided by statute; 3) the notice sent by the county recorder or other officer in charge of elections is returned undeliverable and the voter is unable to be contacted to determine if the voter desires to remain on the list; or 4) the voter fails to vote an early ballot in all elections for two consecutive election cycles as specified (A.R.S. § 16-544).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires the county recorder, on the general effective date and on April 2 in every year thereafter ending in five, to notify each person on the AEVL that their name will be removed from the AEVL in 30 days unless the voter notifies the county recorder of their desire to remain on the AEVL for the next 10 years.

2.   Requires the county recorder to remove the voter from the AEVL if they do not receive information from the voter indicating the voter's choice to remain on the AEVL.

3.   Requires the county recorder to provide the notice on a card mailed to the voter.

4.   Requires the notice to state:

a)   the 30-day time limit; and

b)   that the voter may call the recorder's office, use the county recorder's website portal or return the notification card to indicate that the voter chooses to remain on the AEVL.

5.   Becomes effective on the general effective date.
