ARIZONA STATE SENATE

AMENDED
municipalities; counties; recycling; prohibition
Purpose
Prohibits a municipality, county or other political subdivision of the state from recommending or requiring that a resident place any product in a recycling bin that is not being actively recycled in present time.
Background
A city, town or
county must provide residents with an opportunity to engage in recycling and
waste reduction. The Arizona Department of Environmental Quality (ADEQ)
promotes and recommends methods for the reuse and recycling of solid wastes
consistent with environmental quality policies. The ADEQ oversees the
implementation and operation of the Arizona Recycling Program which encourages
the recycling and proper disposal of plastics (A.R.S. §§ 9-500.07;
11-269;
49-104;
49-832;
and 49-835).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Prohibits a city, town, county or other political subdivision of the state from recommending or requiring that a resident place any product in a recycling bin that is not being actively recycled in present time.
2. Defines actively recycled as a product that is reprocessed into a new product.
3. Becomes effective on the general effective date.
Amendments Adopted by Committee of the Whole
· Applies the recycling prohibition to products that are not being actively recycled in present time, rather than products that are not being actively recycled as of the general effective date.
