Overview

Contains provisions relating to criminal justice needed to implement the FY 2026 budget.

History

The Arizona Legislature adopts a budget for each fiscal year (FY) that contains general appropriations. Article IV, Section 20, Part 2 of the Constitution of Arizona requires the General Appropriations Act (feed bill) to contain only appropriations for the different state departments, state institutions, public schools and interest on public debt. Statutory changes necessary to reconcile the appropriations made in the feed bill and other changes are drafted into separate budget bills. These bills are prepared according to subject area.

Provisions

Sex Offender Management Board (Board)

1.   Places the Sex Offender Management Board (Board) within the Department of Public Safety (DPS). (Sec. 3)

2.   Revises variously the membership and membership requirements for the Board. (Sec. 3)

3.   Modifies the Board from having two co-chairpersons to a single chairperson. (Sec. 3)

4.   Repeals the Board on July 1, 2030, aligning with the repeal date of DPS. (Sec. 9, 10)

Prison-Related Prosecutions

5.   Requires counties to establish an intergovernmental agreement with the Department of Corrections before filing a prosecution cost claim, for prosecution of crimes related to state correctional facilities. (Sec. 4)

6.   Directs the Department of Corrections to file such claims with the Arizona Department of Administration, concurrent with payment of the claim. (Sec. 4)

State Aid to Juvenile Proceedings Fund (Fund)

7.   Changes the distribution formula for the State Aid to Juvenile Proceedings Fund (Fund), from being based on the average juvenile dependency case filings from FYs 2013-2015, to being based on the most recent fiscal year's filings. (Sec. 7)

8.   Caps the maximum distribution any county may receive from the Fund in any given fiscal year at $250,000. (Sec. 7)

 

 

Child and Family Representation Program (Program)

9.   Establishes the Child and Family Representation Program (Program) in the Administrative Office of the Courts, to ensure uniform and high-quality representation and collaboration with the superior courts, judges and attorneys. (Sec. 14)

10.  Instructs the Supreme Court to employ the personnel needed to administer the Program. (Sec. 14)

11.  Outlines Program requirements, including assessing training availability, recommending training and caseload standards, auditing counsel performance, filing bar complaints, fostering partnerships, recommending counsel compensation, seeking funding and developing outcome metrics. (Sec. 14)

12.  Directs the Program to provide an annual report, to designated members of the legislative and executive branches, on the measures being taken to assess the effectiveness of council. (Sec. 14)

13.  Repeals the Program on June 30, 2028. (Sec. 14)

Miscellaneous

14.  Mandates that counties who receive grant monies to operate a Coordinated Reentry Planning Services Program submit an annual report, detailing various program statistics, to designated members of the legislative and executive branches. (Sec. 1)

15.  Defers the prohibition, on using Anti-Racketeering Revolving Fund monies for FTEs, from August 28, 2025 to August 28, 2027. (Sec. 2, 17)

16.  Asserts that Anti-Racketeering Revolving Fund monies may only be used for those purposes outlined in statute. (Sec. 2)

17.  Increases, beginning July 1, 2026, the Corrections Officer Retirement Plan (CORP) Tier 3 employer contribution rate from 5 % to 5.5 %. (Sec. 5, 16)

18.  Transfers administration of the Anti-Human Trafficking Grant Fund from the Arizona Department of Emergency and Military Affairs to DPS. (Sec. 6)

19.  Repeals the committed youth confinement cost sharing fee, and the accompanying Local Cost Sharing Fund, assessed by the Arizona Department of Juvenile Corrections on Maricopa County, on July 1, 2028. (Sec. 8)

20.  Authorizes the Attorney General to annually spend up to $355,000 from the Consumer Protection Consumer-Fraud Revolving Fund on the federally recognized Internet Crimes Against Children Task Force Program. (Sec. 11)

21.  Instructs the Attorney General to annually file a report with designated members of the legislative and executive branches containing information on projections and accountings of opioid settlement monies. (Sec. 12)

22.  Extends the Fentanyl Prosecution, Diversion and Testing Fund from July 1, 2025, to July 1, 2027. (Sec. 13, 17)

23.  Contains an intent clause (Sec. 15)

24.  Makes technical and conforming changes. (Sec. 1, 3, 4, 7, 11)
