Overview
Establishes the Housing Grant Program (Program) to construct military transitional, veteran, affordable or homeless housing in this state. Conforms the Military Transitional Housing Fund (Fund) with the Program by modifying the Arizona Department of Housing's (ADOH) rules on Fund requirements.
History
Laws 2022, Chapter 382, established the Fund consisting of monies allocated from any federal sources, including monies provided by affordable housing legislation and unused or undesignated donations and undesignated federal monies for which military transitional housing is eligible. The Director of ADOH must administer the Fund and Fund monies are continuously appropriated. Monies must be deposited in the Fund by order of the Governor and must be spent on newly constructed transitional housing, in cooperation with veteran owned and operated nonprofit organizations and for-profit organizations that serve military members who are transitioning to veteran status. Monies in the fund are exempt from lapsing. Fund monies must be spent for developing projects and programs to provide transitional housing opportunities for military members separating from the military to be housed in newly constructed housing facilities. Monies cannot be spent on unoccupied hotels and motels designated for homeless veterans (A.R.S. § 41-3955.02).
Laws 2023, Chapter 133, appropriated $1,900,000 from the State General Fund in FY 2024 into the Fund.
Provisions
1. Creates the Program to construct military transitional, veteran, affordable or homeless housing in this state and tasks ADOH with administering the Program. (Sec. 2)
2. Allows grants to be awarded to a veteran-owned and operated nonprofit organization or a veteran-owned and operated for-profit company to construct military transitional housing, veteran housing, affordable housing or homeless housing. (Sec. 2)
3. Clarifies that Fund monies are allocated from any federal sources, including designated federal monies, rather than undesignated federal monies, for which military transitional housing is eligible. (Sec. 1)
4. Mandates that Fund monies must be spent on construction planning for military transitional housing, in addition to be spent on newly constructed transitional housing projects. (Sec. 1)
5. Adds that Fund monies must be spent for constructing a transitional comprehensive care facility that provides supportive housing services in the facility and on-site outpatient medical care and behavioral health services for military members who are transitioning into civilian life. (Sec. 1)
6. Clarifies that ADOH is prohibited from using more than 10% of Fund monies to administer the Fund, rather than prohibited from using 10% of the monies to annually administer the Fund. (Sec. 1)
7. Allows ADOH to use designated federal monies to administer the Fund. (Sec. 1)
8. Eliminates the requirement for ADOH to notify a city, town, county or tribal government (municipalities) that an ADOH-financed construction project is planned for its jurisdiction and, before proceeding, to seek comment from the governing body of the municipalities or an official authorized by the governing body. (Sec. 1)
9. Removes the prohibition for ADOH from interfering with or attempting to override the local jurisdiction's planning, zoning or land use regulations. (Sec. 1)
10. Redefines undesignated federal monies as designated federal monies and modifies its definition. (Sec. 1)
11. Makes technical and conforming changes. (Sec. 1)
