HB 2579: sex offender registry; lifetime registration

Overview

Broadens Arizona's sex offender registration laws, particularly regarding lifetime registration.

History

If a person is convicted of, or adjudicated guilty except insane for, specified sexual offenses, he must register as a sex offender with the county sheriff. The convict must register within 10 days after the conviction or adjudication or within 72 hours after entering and remaining for at least 72 hours in any Arizona county (A.R.S. § 13-3821).

Juvenile convicts required to register with the sheriff automatically have their registration requirement terminated when they turn 25. Additionally, the court may at any time order the termination of any duty to register for a juvenile after successful completion of probation; and the court may order the suspension or termination of any duty to register for an adult after a probation review hearing (A.R.S. §§ 13-3821; 13-923).

Provisions

1.   Expands the registry requirement for the following offences:

a)   those who committed sexual assault of a spouse must register, regardless of the date of the offence;

b)   those who committed child sex trafficking must register, regardless of the date of the offence;

c) any person who commits a second or subsequent offense of indecent exposure must register, regardless if the victim is over or under 15 years old;

d)   any person who commits a second or subsequent offense of public sexual indecency must register, regardless if the victim is over or under 15 years old; and

e)   any person who commits sexual extortion must register, regardless if the victim is over or under 15 years old. (Sec. 1)

2.   Eliminates the provision that automatically terminates juvenile sex offender registration at age 25. (Sec. 1)

3.   Eliminates the 10-year registration limit for individuals convicted of unlawful imprisonment or kidnapping of a minor, and subjects them to lifetime registration. (Sec. 1)

4.   Deletes the requirement that a sheriff who collects a DNA sample from an offender from another jurisdiction must transmit that sample to the Department of Public Safety. (Sec. 1)
