Overview

Appropriates $4,000,000 to the Arizona Department of Corrections (DOC) to distribute to the Navajo County Sheriff's Office for a reentry facility from the Consumer Restitution and Remediation Revolving Fund (Fund) in FY 2026.

History

The Fund consists of two subaccounts-the Consumer Restitution Subaccount and the Consumer Remediation Subaccount (Subaccount). The Fund and both subaccounts are administered by the Attorney General (AG). The Subaccount monies, are exempt from lapsing, and consist of monies collected by the AG as a result of a court order of competent jurisdiction or as a result of a settlement to rectify violations of consumer protection laws. The Subaccount does not hold monies collected for specific persons and court costs, attorney fees, civil fees and other monies recovered in the enforcement of consumer protection laws (A.R.S. § 44-1531.02).

Statute allows the AG to spend Subaccount monies for consumer fraud education programs and operating expenses incurred in implementing programs to rectify violations of consumer protection laws. Monies deposited into the Subaccount from opioid claims-related litigation are subject to legislative appropriation. All other monies, up to $4,000,000, are continuously appropriated annually. Any amount more than $4,000,000 is subject to legislative appropriation.  The AG is required to submit an expenditure plan to the Joint Legislative Budget Committee for review before spending any monies in the Subaccount (A.R.S. § 44-1531.02).

Provisions

1.   Appropriates $4,000,000 from the Subaccount of the Fund in FY 2026 to DOC to distribute to the Navajo County Sheriff's Office for a reentry facility. (Sec. 1)
